Landlords Advertising Property To Let - Are You Registered?

Landlords, do you know that if you are letting property in Scotland you must register with your local authority and it is a legal requirement that you display your landlord registration number and the property EPC rating in any advert for the property.

If you fail to include your landlord registration number and the EPC rating in any advert for the property, then you may be liable to a fine of up to £1000.

Holiday Letting

Residential properties which are let or occupied for holiday purposes are exempt from registration. Distinguishing genuine from sham holiday use can be difficult, and the facts of each individual use must be scrutinised. It may be helpful to refer to the definition adopted by HM Revenue and Customs reproduced below -

"The conditions to be met are set out below ICTA88/S504(3) and all three must be satisfied if a property is to qualify -

* - the accommodations must be available to the public generally as holiday accommodation for not less then 140 days.

* - the periods for which it is so let must amount (in aggregate) to at least 70 days

* - for at least 7 month the property must not be in the same occupation for more than 31 days

A property that is let on a long-term basis cannot be regarded as available for holiday letting.

A property that is owner-occupied for part of the year cannot be regarded cannot be regarded as available for letting while it is owner occupied. Nevertheless the words 'in same occupation' should be interpreted as 'in the same occupation' and do not preclude relief to an owner who moves out of his home during the holiday season and returns to live there when the season is over."
